Board of Health Minutes 06/30/05

MINUTES
EASTHAM BOARD OF HEALTH MEETING
THURSDAY JUNE 30, 2005 P.M.


PRESENT:        Paul Lothrop, Chairman, Pat Lariviere, Stan Holt,
                        Jane Crowley, Health Agent   (Dr. Taylor absent)


The Chairman opened the meeting at 3:p.m.

VARIANCES:



Boswick         270 Alston Ave          Map-11     Parcel-19
        
Emily Beebe presented the plans to upgrade the septic system. The variances requested:
        310 CMR 15.402 and 403 (1)
Reduction of system location setbacks to property lines - leaching trenches 10' required 1' provided
Reduction of system location setbacks to cellar wall
       Septic tank:  10' required, 6' provided    Leaching trenches:  20'provided,  7' provided
Reduction of system location to a Bordering Wetlands
                Leaching trenches : 50' required, 34' provided

Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:



        1.       No increase in flow allowed
       2.       Deed restriction to 2 bedrooms
       3.       Well to be tested for VOC and routine parameters
       4.       1500 gal tank (new tank) required
       5.       D Box cover within 6" of finish grade
       6.       Covers to within 6' finish grade on each trench
          7.    Request to have building inspector confirm egress to conform to     building code.


Stan Holt made the motion to appove the plans  with the 7 conditions.
Pat Lariviere seconded the motion.             VOTED 4-0 FOR APPROVAL



Edmonds         2 Nycoma Way            Map-10      Parcel-322

Alan Cabral  (Felco Engineering) presented plans to upgrade from cesspools to Micro Fast.system
        The variances requested are as follows:
        310 CMR  15.000

        1.      30' from proposed well to leach area (pcl, 324) -310 CMR 15.211
        2.      28' from proposed well to leach area (Locus)
        3.      10' from proposed well to leach area (pcl.321)
        4.      5'   from leach area to property line  (pcl. 279)
        5.      5'   from leach area to property line (Street)
        6.      13' from leach area to cellar wall (Locus)
        7.      22' from proposed well to property line (Street) - Eastham Well Regulations
        8.      5'   from proposed well to property line (pcl. 321)


Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:

        1.      Routine and VOC water quality test results be provided of proposed well location to assure potability
        2.      No increase in design flow be allowed           
        3.      Secondary treatment and monitoring under general use approval conditions per DEP regulations but also to include testing  quarterly for total nitrogen, BOD, TSS, Nitrate (or 2 times per year for seasonal use)  with effluent limit not to exceed19 mg/l nitrate -nitrogen per Eastham Board of Health requirement.  after this time reduction of testing could be requested to BOH by owner.
        4.      Operation and maintenance agreement to be submitted to EBOH.  Operation and maintenance agreement to be required for life of the system.  Operator be required to report results via Barnstable Coutnty Carmody Data Base (when available) or directly to Eastham Health Department if data base is not available


Deed restriction for 2 bedrooms use and use alternative technology requirement to be recorded on deed.
Designer to verify proper operation of the system prior to issuance of Certificate of Compliance
7       Any increase in habitable square footage would require Board of Health review
8       Well disclaimer form to be signed by owner.
                
Stan Holt made the motion to approve the plans with the 8 conditions.
Pat Lariviere seconded the motion.       THE VOTE WAS 4-0 FOR APPROVAL
 

  
3.       Murphy         3090 State Highway              Map-12  Parcel-327

Alan Cabral (Felco Engineering) presented plans to upgrade the septic system.  The variance requested :

        Eastham Board of Health Regulations:
        1.      9' from well to property line (street)

 
Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:



Require well disclaimer signed by the owner.
       2.      As built with distance to D Box and elevation of bottom leach area and all covers  within 6" of grade on tank, D Box & leach area

Joyce Gibson made the motion to approve the plans with the 2 conditions.
Stan Holt seconded the motion.        VOTE WAS 4-0 FOR APPROVAL
                                                                                                







4.      O’Hara          35 Cove Road            Map-15     Parcel-43

Terry Ryder (Ryder/Wilcox) present a plan to relocate the well.  The variance requested is as follows:

Town of Eastham Board of Health Private Well Regulations -Well Location:



 The proposed locus well shall be feet from the roadway where 25    feet  is required.  A16-foot variance is requested

Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:
        1.      Well variance form to be signed by owner
        2.      No increase in flow
        3.      Deed restriction for 3 bedrooms to be recorded
        4.      Well to be tested for voc and routine parameters
        5.      All covers within 6"of grade6.  


Contingent on approval of plan for 25 Cove Road   

Joyce Gibson made the motion to approve the plans  with the 6 conditions
Stan Holt seconded the motion.          THE VOTE WAS 4-0


 


 Micelle                25 Cove Road            Map-18   Parcel-42


        Terry Ryder (Ryder/Wilcox)      presented a plan to relocate the well.
        The variances requested  is as follows:

Town of Eastham Board of Health Private Well Regulations:  Well Location

1.      The proposed locus well shall be 9 feet from the roadway, where 25 feet is required and 4 feet from the property line to the east, where 10 feet is required. 16 and 6 foot variances.
                                                        
Finding that the plan achieves maximum feasible compliance, the aforementioned variance was approved with the following conditions:


Well variance form to be signed by owner
        2.      Well to be tested for VOC and Routine parameters

Pat Lariviere made the motion to approve the plans  with the 2 conditions
Joyce Gibson seconded the motion.          VOTE WAS 4-0 FOR APPROVAL

II.     REVIEW
        
1.      Healy                   60 Bridge Pond Rd.      Map-13    Parcel-44

Chris Wickson  (East Cape)  presented plans for Piloting Approval for a Septitech Processor Model M-400 system to allow a 4 bedroom dwelling to be constructed.

Finding that the plan achieves maximum feasible compliance, the plans were approved with these conditions:
        1.      Voc and routine water quality test results be provided of proposed well location to assure potability
        2.      No increase in design flow be allowed
        3.      Deed restriction for 4 bedroom use and use of alternative system to be recorded on deed
        4.      The plan is subject to DEP approval and required to meet 19/mg/l nitrogen and piloting approval criteria.
        5.      Applicant be required to submit quarterly test results to via Barnstable County Carmody  Data base if available or Eastham Health Department directly if the Data base is not available on the following parameters (if used year round or prorated equivalent) on effluent for a period of 2 years minimum:  PH, BOD, TSS, Nitrate and Total Nitrogen.  After two years of monitoring and at the request of the owner the testing requirement may be reduced.  All monitoring data shall be submitted within 30 days of sampling date.
        6.      Operation and maintenance contract required for life of the system.
        7.      Designer to verify operation of system at time of installation

Stan Holt made the motion to approve the plans with the 7 conditions.  Pat Lariviere seconded the motion.      THE VOTE WAS 4-0 FOR APPROVAL



Joyce Gibson left the meeting.



        CORRESPONDENCE/OTHER INFORMATION

Pat Lariviere made the motion to make the Board of Health Regulations effective July1, 2005 and adopted June 6, 2005.
        Stan Holt seconded the motion .        
          VOTE WAS 3-0 FOR APPROVAL
        
       Discussion about Beach testing program.

       Letter from Raquel Ellis (Vice-Chairman Brewster Board of Health) asking for the support of the Eastham Board of Health for the “No Child Left Behind Act” which promotes healthy eating in the schools.
        The Board approve 3-0 for supporting this bill.


        The meeting was adjourned at 5;15p.m.
